These Terms & Conditions ("Terms") govern your access to and use of hemotique.com and related services operated by Hemotique ("Hemotique", "we", "us", or "our"), including our Website, mobile application, and API (together, the "Services").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. About Hemotique
Hemotique is a digital platform that helps connect voluntary blood donors with people and organizations seeking blood, share blood availability information, publish articles and events, and support community engagement around blood donation.
Important: Hemotique is not a medical provider, hospital, blood collection center, or emergency response service. We do not guarantee blood supply, medical outcomes, or response times. In a medical emergency, contact local emergency services or go to the nearest hospital immediately.
2. Eligibility and accounts
- You must provide accurate registration information and keep your account credentials secure.
- You are responsible for activity under your account.
- You must be legally able to enter into these Terms in your jurisdiction.
- Some features require email verification or additional profile details before use.
- We may suspend or terminate accounts that violate these Terms or pose security or abuse risks.
3. User categories and responsibilities
The Services support different account types, including donors, patients, volunteers, hospitals, and blood banks. You agree to:
- Use only the account type and features appropriate to your role;
- Provide truthful information in profiles, donation requests, testimonials, and reports;
- Respect the privacy and dignity of patients, donors, and other users;
- Not impersonate another person or organization;
- Not use the Services for unlawful, harmful, harassing, discriminatory, or fraudulent activity.
4. Donation requests and donor responses
- Users who create donation requests are responsible for the accuracy of the information they post and for obtaining any consent required to share patient-related details.
- Donors who respond to requests act voluntarily and must follow applicable medical guidance and hospital procedures. Hemotique does not conduct medical screening in place of a licensed facility.
- Any in-person donation, testing, or transfusion occurs outside our platform and under the responsibility of qualified healthcare providers.
- We may remove, hide, or modify requests that appear false, duplicate, abusive, outdated, or otherwise harmful to the community.
5. Health screening and emergency assist features
Optional donor health screening tools and emergency assist messaging are provided for informational and coordination purposes only. They do not constitute medical advice, diagnosis, or emergency dispatch. Always consult qualified healthcare professionals for medical decisions.
6. Organization subscriptions and payments
Certain hospital and blood bank features may require a paid subscription when organization billing is enabled by Hemotique.
- Plan limits, pricing, billing periods, and grace periods are described on the billing pages and in your account.
- Manual payments (bank transfer, eSewa, Khalti) are reviewed by our team before activation.
- Online card payments may be processed by third parties such as Stripe under their terms.
- Failure to renew may result in downgrade to a free plan and removal of premium data after any applicable grace period, as disclosed during checkout and in account notices.
- Fees paid are generally non-refundable except where required by law or explicitly stated otherwise.
7. Content you submit
You retain ownership of content you submit (such as posts, testimonials, messages, and images), but you grant Hemotique a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content solely to operate and promote the Services.
You must not submit content that:
- Infringes intellectual property or privacy rights;
- Contains malware or harmful code;
- Is defamatory, obscene, or misleading;
- Violates applicable law.
We may remove content or accounts that breach these rules.
8. Our content and intellectual property
The Hemotique name, logo, Website design, software, and original materials are owned by Hemotique or our licensors. You may not copy, modify, reverse engineer, or resell the Services except as allowed by law or with our written permission.
9. Advertisements and third-party services
The Website may display third-party advertisements (including Google AdSense) and links to external services. We do not control and are not responsible for third-party content, products, or policies. Your dealings with advertisers or external sites are between you and them.
10. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
11. Availability and changes
We strive to keep the Services available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with or without notice, especially for maintenance, security, or legal reasons.
We may update these Terms from time to time. The effective date at the top will change when we do. Material changes may be communicated through the Website or by email where appropriate. Continued use after changes means you accept the updated Terms.
12. Disclaimer of warranties
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
13. Limitation of liability
To the fullest extent permitted by law, Hemotique and its operators, staff, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or life-saving outcomes arising from your use of or inability to use the Services, including reliance on donation requests, donor responses, availability data, or communications on the platform.
Our total liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid Hemotique in the twelve (12) months before the claim, or (b) one hundred US dollars (USD 100), except where liability cannot be limited under applicable law.
14. Indemnity
You agree to indemnify and hold harmless Hemotique from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your content, your violation of these Terms, or your violation of any rights of another person or entity.
15. Governing law and disputes
These Terms are governed by the laws applicable in our primary place of operation, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise.
We encourage you to contact us first to resolve concerns through our Contact Us page. If a dispute cannot be resolved informally, it shall be subject to the competent courts of that jurisdiction unless applicable law requires a different forum.
